ИЗМЕНЕНИЯ В ЗАКОНОДАТЕЛЬСТВЕ

В соответствии с Федеральным законом от 29.06.2015 года № 176-ФЗ «О внесении изменений в Жилищный кодекс Российской Федерации и отдельные законодательные акты Российской Федерации» внесены изменения в федеральные законы, устанавливающие правовые гарантии на предоставление мер социальной поддержки по оплате жилого помещения и коммунальных услуг льготным категориям граждан.

Изменения затронули льготников федерального уровня:

- инвалидов Великой Отечественной войны, участников Великой Отечественной войны и приравненных к ним лиц; членов семей погибших (умерших) инвалидов войны,

- участников Великой Отечественной войны, ветеранов боевых действий;

- лиц, награжденных знаком "Жителю блокадного Ленинграда";

- граждан, подвергшихся радиационному воздействию вследствие катастрофы на ЧАЭС, и приравненные к ним лиц;

- членов семей граждан, подвергшихся радиационному воздействию вследствие катастрофы на ЧАЭС, и приравненных к ним лиц;

- инвалидов и семей, имеющих детей-инвалидов.

Согласно внесенным изменениям с 30.06.2015 года вместо мер социальной поддержки по оплате жилого помещения и коммунальных услуг, указанным категориям граждан, предоставляется компенсация расходов на оплату жилых помещений и коммунальных услуг в размере 50-ти процентов. Компенсация предоставляется по одному льготному основанию, наиболее выгодному для льготника.

Для инвалидов, семей, имеющих детей-инвалидов, граждан, подвергшихся радиационному воздействию вследствие катастрофы на ЧАЭС, и приравненным к ним лицам, компенсация расходов на оплату коммунальных услуг, рассчитывается исходя из объема потребляемых коммунальных услуг, определенного по показаниям приборов учета, но не более нормативов потребления, утверждаемых в установленном законодательством Российской Федерации порядке.

Меры социальной поддержки по оплате жилых помещений и коммунальных услуг не распространяются на установленные Правительством Российской Федерации случаи применения повышающих коэффициентов к нормативам потребления коммунальных услуг.
